Who we are
This website and the Tiber Fuel customer portal are operated by Tiber Industries LLC ("Tiber Fuel," "we," "us"). By accessing the site, requesting a quote, or using the portal, you agree to these Terms and Conditions. If you do not agree, please do not use the site.
Using the site
You may use this site only for lawful purposes and in a way that does not infringe on the rights of others or restrict their use of the site. You agree not to attempt to gain unauthorized access to any part of the site, the portal, our servers, or any connected systems, and not to introduce malicious code or interfere with normal operation.
Quote requests and estimates
Submitting a quote or service request through the site does not create a binding contract and does not obligate Tiber Fuel to provide a quote, price, or service. Any pricing shown on the site or produced by our fuel calculators is an estimate for planning purposes only. Final pricing is confirmed in a written quote or invoice, and fuel prices, taxes, and surcharges can change based on market conditions and delivery details.
Portal accounts
When you create a portal account you are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us promptly if you believe your account has been accessed without authorization. You agree to provide accurate information when you register and to keep it up to date. We may suspend or close an account that is inactive, that we believe is being misused, or that violates these terms.
Orders, invoices, and payment
Services are provided subject to the terms of the specific quote, order, or invoice you agree to. Fuel and equipment deliveries are also governed by the Tiber Fuel Credit Application & Account Agreement you accept; if that agreement conflicts with these website terms, the account agreement controls for that transaction. Payment terms, delivery windows, and any minimums or fees are stated on your document. Amounts that are past due may be subject to late charges as permitted by law and as stated on your invoice.
Payment authorization — cards and ACH
If you pay by card, a payment processing surcharge (currently 3.5%) is added and shown before you confirm; paying by bank transfer or ACH has no surcharge. If you authorize ACH debits — on paper or through the portal — you allow Tiber Fuel to initiate electronic debits from the bank account you provide for amounts due on deliveries and invoices, until you cancel the authorization in writing with reasonable time for us to act. You are responsible for bank charges and reasonable processing fees on returned, rejected, or reversed payments, as permitted by law.
Text messages (SMS)
If you provide a mobile number and opt in, you consent to receive account, delivery, and service text messages from Tiber Fuel at that number, including messages sent by automated means. Message and data rates may apply and message frequency varies. Reply STOP to opt out or HELP for help; opting out of texts does not stop essential account emails. Consent to receive texts is not a condition of purchase.
Electronic communications and signatures
By using the site and portal, you consent to receive communications, disclosures, agreements, and records from us electronically, and you agree that typing your name or clicking to accept serves as your electronic signature and is as legally binding as a handwritten one. You may request a paper copy of any signed document by contacting us.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Tiber Industries LLC and its owners, employees, and agents from claims, damages, and reasonable costs (including attorney’s fees) arising out of your misuse of the site or portal, your violation of these terms, or your violation of another party’s rights. This is in addition to any indemnity in your service agreement or account terms.
Intellectual property
The site, its content, branding, and the portal software are owned by Tiber Industries LLC or its licensors and are protected by applicable law. You may not copy, reproduce, or redistribute any part of the site except as needed to use the services we provide to you.
Disclaimers
The site and portal are provided on an "as is" and "as available" basis. We work to keep the site accurate and available, but we do not warrant that it will be error-free, uninterrupted, or free of harmful components, or that calculator estimates will match final pricing.
Limitation of liability
To the fullest extent permitted by law, Tiber Industries LLC will not be liable for any indirect, incidental, or consequential damages arising out of your use of, or inability to use, the site or portal. Nothing in these terms limits liability that cannot be limited under applicable law.
Changes to these terms
We may update these terms from time to time. Changes take effect when we post the updated version on this page. Your continued use of the site after we post changes means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules, and any disputes will be handled in the state or federal courts located in New Mexico.
